Welcome to DET Trainer. These Terms of Service (the “Agreement”) govern your access and use of DET Trainer’s websites, mobile applications, and related services (collectively, the “Services”). This Agreement is important, as it outlines your legal rights, so please read it carefully.

By accessing or using any of the Services provided by DET Trainer or its affiliates (hereinafter referred to as “DET Trainer,” “we,” “us,” or “our”), including but not limited to dettrainer.com (the “Site”), you agree to be bound by the terms of this Agreement, as well as any additional terms or conditions that may apply to specific Services. Your continued use of the Site constitutes your acceptance of this Agreement and any future amendments. If you do not agree, you must discontinue your use of the Site.

1. Changes to the Agreement

We may revise this Agreement at any time at our discretion. If we do so, we will update the “Last Revised” date at the top of this page and provide you with notice of material changes through a pop-up notice, email, or other reasonable means. Your continued use of the Site after any changes to this Agreement constitutes acceptance of the revised terms.

2. Arbitration and Class Action Waiver

Please Note:

Except for specific disputes mentioned below, all disputes between you and us must be resolved through binding individual arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration. This is a legally binding provision that affects your rights, so please review it carefully.

3. Privacy Policy

4. Eligibility

– You represent and warrant that you are at least 13 years old. If you are under 13, you are not permitted to use the Site or the Services for any reason.
– For minors under the age of consent, a parent or legal guardian must read and accept this Agreement on the minor’s behalf.
– You agree to comply with all applicable laws, rules, and regulations when using the Services.

5. Registration

You may register for an account to access certain features of the Site. You agree to provide accurate and up-to-date information during registration and maintain the confidentiality of your account credentials. DET Trainer reserves the right to suspend or terminate your account for violations of this Agreement or any misuse of the Services.

6. Intellectual Property

– Content Ownership: All materials on the Site, including but not limited to text, graphics, software, and images (the “Content”), are owned by DET Trainer or third-party licensors and are protected by intellectual property laws. You may not copy, distribute, modify, or otherwise exploit any part of the Content without prior written consent from DET Trainer.
– Trademarks: DET Trainer’s trademarks, logos, and service marks (collectively, the “Trademarks”) are the exclusive property of DET Trainer. Unauthorized use of the Trademarks is prohibited.

7. Use of Services

Upon purchasing a subscription to DET Trainer’s Services, you are granted a non-exclusive, non-transferable license to access the software for the subscription term. You may not share your login credentials with others, reverse engineer, or otherwise tamper with the software.

8. Payments and Subscriptions

– Payment: You agree to provide accurate payment information. DET Trainer uses a third-party payment processor, and you authorize them to process payments on your behalf. Any fees or charges related to your payment method (e.g., handling fees by your card issuer) are your responsibility.
– Subscriptions: By selecting a recurring subscription, you authorize DET Trainer (or its payment processor) to charge you periodically. You can cancel your subscription by emailing support@dettrainer.com. Note that cancellations do not affect charges already incurred for previous orders.

9. Limitation of Liability

To the maximum extent permitted by law, DET Trainer and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services. Your sole remedy is to discontinue the use of the Services.

10. Dispute Resolution and Arbitration

If you have any dispute related to this Agreement or the Services, you agree to first attempt to resolve the issue informally by contacting DET Trainer. If we cannot resolve the dispute within 30 days, the issue may be submitted to binding arbitration administered by JAMS under the Federal Arbitration Act (FAA).

– Arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.
– Any arbitration or legal proceedings will be confidential, and arbitration fees will be handled as outlined by JAMS rules.

11. Miscellaneous

– Governing Law: This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles.
– Severability: If any provision of this Agreement is found to be invalid, the remainder of the Agreement shall remain in full force and effect.
– Entire Agreement: This Agreement constitutes the entire agreement between you and DET Trainer regarding the Services and supersedes any prior agreements.
